Unionfab offers a variety of services aimed at aiding customers and potential customers in the manufacturing of their parts and assemblies. Through our platform, www.unionfab.com (referred to as the “Website“), customers (collectively referred to as “You”) can interact with Unionfab and provide us with information. This information may be shared through our software plug-ins, online platform, or by communicating with our employees and representatives in support of the services we offer as part of a customer. We, Unionfab (“Unionfab” or “we” or “us“), have formulated this Privacy Policy to elucidate our privacy practices concerning the information collected from you during your visit to the Website and utilization of our Services.

This Privacy Policy is designed to inform you about how Unionfab collects and processes your personal data when you use the Website and our Services for our own purposes, where we act as the Controller. It is intended to fulfill our obligations as a Controller of Transparency under the General Data Protection Regulation (GDPR) in Europe. Please note that this Privacy Policy does not cover how we process personal data on behalf of our customers or any other person’s instructions, where we act as a Processor.

Our Privacy Policy may undergo occasional revisions. If we make any significant changes to how we use your personal data, we may notify you by email to the last email address you provided to us and/or by prominently posting notice of the changes on our Website. Changes will be effective thirty (30) calendar days following our dispatch of an email notice to you or thirty (30) calendar days following our posting of notice of the changes on our Website. These changes will be immediately effective for new users of our Services. It is your responsibility to ensure your personal data is up to date. If you do not wish to allow changes in our use of your personal data, you must notify us before the effective date of the changes to deactivate your Account. We gather information about you through various means when you utilize our Website and Services. This information includes the following:

Information You Provide

We collect data that you voluntarily provide to us, which may include:

  • Personal information such as your first and last name, phone number, email address, company name, job title, and password when you create an account to access our Customer or Manufacturing Partner network (“Account”).

  • Personal information such as your first and last name, phone number, email address, company name, and job title when engaging in conversation with a chatbot (“Bot”) or through electronic or non-electronic communication.

  • When accessing Services on our Website, we collect all necessary information to complete the transaction you have requested or authorized. This may include your name, email address, credit card information, bank account details, social security number and/or tax identification number, billing details, and shipping information.

  • We retain information on your behalf to maintain and service your Account and deliver the Services.

  • If you provide feedback or contact us via email, we collect your name, email address, and any other content included in the email to respond to your query.

  • In certain cases, we may request photocopies of your ID and related documents for fraud prevention and identity verification purposes.

  • Participation in our surveys involves collecting the information you provide.

  • We may also gather personal information from other areas of our Website where it is explicitly stated that such information is being collected.

  • If you provide feedback or contact us via text message (“SMS”), we collect your name, phone number, and any other content included in the SMS to respond accordingly.

Information Collected Through Technology

We automatically collect certain information through various technological means. This information is gathered in the following ways:

  • Log Files: Similar to most websites, we automatically gather certain information and store it in log files. This includes aggregated data on the pages accessed or visited by customers (though not individual user pages), IP addresses, browser types, Internet Service Providers (ISPs), operating systems, date/time stamps, and clickstream data. We utilize this information to analyze trends, administer the Website, and enhance our Services to better suit our users’ needs.

  • Cookies: Like many online services, we utilize cookies to gather information. “Cookies” are small files that websites or service providers transfer to your computer’s hard drive through your web browser, enabling the website’s or service provider’s systems to recognize your browser and capture and remember certain information.   • Pixel Tags: Additionally, we employ “Pixel Tags” (also known as clear GIFs, Web beacons, or Web bugs). Pixel Tags are minuscule graphic images with a unique identifier, similar in function to Cookies, used to track online movements of Web users. Unlike Cookies, which are stored on a user’s computer hard drive, Pixel Tags are invisibly videoded in Web pages. Pixel Tags also enable us to send email messages in a readable format and inform us whether emails have been opened, ensuring that we only send messages of interest to our users. We may use this information to reduce or eliminate messages sent to a user.

  • Third-Party Analytics: We utilize third-party service providers such as Google Analytics to assist in analyzing how users utilize the Website (“Analytics Providers”). Analytics Providers employ Cookies to collect information such as frequency of Website visits, visited pages, and previous sites visited before accessing the Website. We utilize the information obtained from Analytics Providers solely to enhance our Website and Services. Analytics Providers only collect the IP address assigned to you at the time of Website visit, rather than your name or other personally identifying information. We do not merge the information obtained through the use of Analytics Providers with your personal data.

No Special Categories of Personal Data

We do not collect any “Special Categories of Personal Data” about you, including details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, genetic and biometric data, or information about criminal convictions and offenses.

2.How We Utilize Your Personal Information

General Usage:

We will solely utilize your personal data for the purposes for which it was initially collected, as outlined below, unless we reasonably determine that it is necessary to use it for another purpose that aligns with the original intent.

If we require using your personal data for an unrelated purpose, we will update this Privacy Policy and provide an explanation of the legal basis allowing us to do so.

What Constitutes Our “Legal Basis” for Processing Your Personal Data?

For each purpose in which we use your personal data, the GDPR mandates that we have a “legal basis” for such usage. Typically, we rely on one of the following legal bases:

User Testimonials.

We frequently receive testimonials and feedback from users who have had positive experiences with our Services. On occasion, we may choose to publish such feedback. When publishing this content, we may identify our users by their first and last names, company names, and may also include their hometowns. Prior to posting any user’s name alongside their testimonial, we obtain their explicit consent.

Creation of Anonymous Data.

From the specifications and any personal information we gather, we may generate anonymous data by removing identifiers such as names that would render the information personally identifiable. This anonymous data allows us to analyze request and usage patterns, thereby improving the content of our Website and enhancing our Services, including refining our pricing algorithms. We reserve the right to utilize anonymous data for any purpose and disclose it to third parties at our discretion.

3.How Long do We Store Your Data?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than   the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

4.Consequences of Non-Provision of Necessary Personal Data

If we require processing your personal data to comply with legal obligations or to fulfill contractual terms with you, and you fail to provide the requested data, we may be unable to perform the contract we have or are attempting to enter into with you. For instance, we may be unable to provide Website functionalities (e.g., account setup or quotation) or fulfill a request you make (e.g., product demonstration).

Should this occur, we may need to suspend your Account, and we will notify you accordingly at the time.

5.Do We Share Your Information With Third Parties?

  • Sharing with Third-Party Service Providers: Your personal information may be shared with third-party service providers to facilitate the provision of Services offered through our Website, conduct quality assurance testing, assist in account creation, provide technical support, and deliver other services on behalf of Unionfab.

  • Sharing Customer Personal Information with Manufacturing Partners: To fulfill the manufacturing of parts ordered through our Services, Unionfab may subcontract a Customer’s manufacturing project to one of our Manufacturing Partners. As part of this process, we may share your information with our Manufacturing Partners to enable them to manufacture the specified parts, assemblies, and related items.

  • Sharing Manufacturing Partner Personal Information with Third-Party Business Partners: We may also share Manufacturing Partners’ personal information with a select number of third-party business partners who facilitate the delivery of Services for those Manufacturing Partners enrolled in our payment or card programs. These partners aid in the delivery of card and payment programs, such as payment processors, credit card network services, and banks or financial institutions. The use of your personal information by these third-party business partners will be governed by their respective privacy policies.

  • Corporate Restructuring: Your personal information may be shared, in whole or in part, in connection with or during negotiations of any merger, financing, acquisition, or dissolution, as well as in transactions or proceedings involving the sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business, or assets, they will assume the rights and obligations regarding the personal information as described in this Privacy Policy.

  • Other Disclosures: Irrespective of any choices you make regarding your personal information (as detailed below), Unionfab may disclose personal information if it believes in good faith that such disclosure is necessary: (a) in connection with any legal investigation; (b) to comply with applicable laws or respond to subpoenas or warrants served on Unionfab; (c) to safeguard or defend the rights of Unionfab or users of the Website or Services; and/or (d) to investigate or aid in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Service.

6.Ensuring the Security of Your Personal Data.

We have implemented commercially reasonable security measures to safeguard your personal data against accidental loss, unauthorized access, use, alteration, or disclosure.

Additionally, we have established procedures to address any actual or suspected personal data breaches. In the event of such breaches, we collaborate with relevant regulators and, where legally required, may notify you of breaches affecting your personal data.

Furthermore, we only retain your personal data for as long as necessary for the purposes outlined above, unless a longer retention period is mandated by law.

Access to your personal data is restricted to employees and personnel who require such access for legitimate business purposes, all of whom are bound by a contractual obligation of confidentiality.

7.Children and Teens

The privacy of Children is important to us. We provide a separate experience for Children in the United States, in which we collect and process only limited information.

The Platform otherwise is not directed at Children. If we become aware that personal information has been collected on the Platform from a Child, we will delete this information and terminate the Child’s account. 8.Your Rights Regarding Your Personal Data

Under certain circumstances, you have the right to:

  • Request correction of your personal data: You can request the correction of any incomplete or inaccurate information we hold about you.

  • Request erasure of your personal data: You can ask us to delete or remove personal data where there is no valid reason for its continued processing, or where you have exercised your right to object to processing.

If you wish to object to this processing, you can follow the opt-out instructions provided in the marketing emails you receive or contact us directly using the information provided above. Upon receipt of your objection, we will promptly cease processing your personal data for marketing purposes. Please note that we may still send you service-related communications, such as updates to our Terms of Use or Privacy Policy, regardless of your marketing preferences.

You will generally not be charged a fee to access your personal data or to exercise your rights. However, in cases where your request is unfounded, repetitive, or excessive (excluding Consent Withdrawal), we may charge a reasonable fee or refuse to comply with your request.

For security purposes and to ensure that personal data is disclosed only to individuals with the right to access it, we may need to request specific information to confirm your identity before processing your request. We may also contact you for additional information to expedite our response.

We aim to respond to all legitimate requests within one month. However, if your request is particularly complex or if multiple requests have been made, it may take us longer to respond. In such cases, we will notify you and provide updates on the progress of your request.

These linked sites have separate and independent privacy policies, and we do not have control over and do not review these linked sites. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our Website and welcome any feedback about these linked sites (including if a specific link does not work).

12.Online Policy Only

This Privacy Policy applies only to information collected through our Website and Services and not to information collected by us offline.

13.Do Not Track Signals

Some web browsers may transmit “do not track” signals to the websites and other online services with which your web browser communicates. There is no standard that governs what, if anything, websites should do when they receive these signals. We currently do not take action in response to these signals. If and when a standard is established, we may revise our policy on responding to these signals.

14.Third Party Tracking and Online Advertising

We use Google Analytics to recognize you and link the devices you use when you visit Unionfab.com, log in to your account on our service, or otherwise engage with us. Google Analytics allows us to better understand how our users interact with our services and to tailor our advertisements and content to you. We may also utilize certain forms of display advertising and other advanced features, such as  Google AdSense, Tiktok, Facebook and Bing. These features enable us to use first-party cookies and third-party cookies(such as the Google AdSense advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to our services. We do not process consumer's sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additional provided information as soon as we finish verifying you.
